Analysis of Technology, Culture and Victims in Crime

There is a strong association between substance abuse and delinquency.
When this happens, families of the offender and the community usually
suffer and there is an increased burden on the juvenile justice system.
Consequences of substance abuse among the young are usually accompanied
by other problems like poor relationships with peers, involvement with
the juvenile system and academic difficulties among others (Gottfredson,
2000).
Possession and other drug use are illegal for youths an intervention
and arrests by the juvenile system is inevitable due to the link between
substance abuse and delinquency. Some of the problems often linked to
adolescents substance use include lack of social controls, negative peer
groups and family problems. Juan having been an alcoholism and having
drugs found in his locker had committed the illegal crime of drugs
possession for delinquents. Any crime is anything that consists of
breaking cultural law or written law thus Juan and Jamal had a crime of
fighting in school which ultimately turned to be a broken criminal code.
Fight instigation amounts to school delinquency which leads to other bad
and high risk behaviors in school.
Both Jamal and Juan were victims this is because the witnesses and the
school video recordings gave contradictory statements, this means that
there was a possibility that both were involved in delinquency acts.
Based on Jamal’s previous disorderly behavior and Juan’s involvement
with drugs, both students did not conform to the social responsibility
of maintaining order in school (Eith, 2005). They however have rights to
be distinguished between minor and major delinquent behavior,
incorporation of measures of minor and major drug use should be
considered. The victims would suffer loss and health problems. There
were possibilities of being incarcerated if they were found guilty on
any of the charges.
Some of the legal issues that arise out of Juan’s and Jamal’s
scenario are whether the children were aware of the discipline policies
and codes of conduct within the school compound. The question of whether
the police made the right arrest in arresting Juan and whether they
should have made the arrest before investigation to know who was on the
wrong between Jamal and Juan would also arise.
Ethnical student diversity could play a big role in the delinquents’
behavior among students. This may be out of the discrimination
perception that prevails in schools. Intolerance of discrimination and
diversity could lead to higher cases of delinquency. Some of the ethical
practices that the police could use include patience while investigating
to get to the bottom of the scenario. The backgrounds of the students
should also be checked to make sure there isn’t any correlation. The
police should also be careful so that the social interests for instance
social order are not overlooked, this may require competency from the
police department.
Technology has been utilized in courtrooms in this regard the video
must be properly authenticated and must also be relevant to the case at
hand. On authentication, the chain of custody ought to be shown for the
video tape to be admissible as evidence. This is done to avoid some
instances of message distortion, editing of chronological events and so
on. In Juan and Jamal’s case the video tape could have been distorted
or the tape edited to rearrange the events of the fight. Thus, the tape
ought to be authenticated for it to admissible in a court of law.
